ENERGI TERMS & CONDITIONS

Please read these Terms & Conditions (“Terms”) carefully before using www.energistudios.co (“the Site”) operated by Energi, LLC  ("Energi," "we," "our," or "us"). This Agreement sets forth the legally binding terms and conditions for your use of the Site at www.energistudios.co.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms. Capitalized terms are defined in this Agreement. These Terms of Service set forth the legally binding terms for your use of Energi’s Services. You are only authorized to use Energi’s Services (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and to these Terms. Please read these Terms carefully and save them. If you do not agree with them, you should leave the Energi website and discontinue use of Energi’s Services immediately. If you wish to become a Member, you must read these Terms and indicate your acceptance during the registration process.

(1) Services

Energi offers heated and non-heated Pilates, Yoga, and Strength Training classes, as well as private and semi-private sessions, at our Cleveland, Ohio, studio. Our website serves as an informational resource and as a scheduling platform for clients to book classes and manage their accounts through our third-party booking platform, Mariana Tek. 

All classes, services, and pricing are subject to availability and may change at any time without prior notice.

(2) Account Registration

To book classes or purchase memberships and packages, you must create an account through Mariana Tek. When registering, you agree to:

  • Provide accurate, current, and complete information

  • Keep your account credentials confidential

  • Accept responsibility for all activity that occurs under your account

  • Notify us immediately of any unauthorized use of your account

Energi is not responsible for any loss or damage resulting from unauthorized access to your account due to your failure to safeguard your login credentials. We reserve the right to suspend or terminate accounts at our discretion.

(3) Booking & Attendance

All classes must be booked in advance through our website or the Mariana Tek platform. Walk-ins are subject to availability. By booking a class, you agree to the following:

  • You must arrive on time. Because our studio operates as a single-room space, the doors will lock 5 minutes after class begins to avoid disruptions and maintain a safe experience for everyone. Late entry will not be permitted, and clients who arrive after the doors are locked will forfeit their class credit or be subject to a late cancellation fee.

  • Your reserved spot may be released to a waitlisted client if you are not checked in at the start of class.

  • If you are on the waitlist and are moved into a class, it is your responsibility to cancel if you cannot attend.

(4) Cancellation & No-Show Policy

We understand that schedules change. To be respectful of our instructors and fellow members, we enforce the following cancellation policy:

  • Cancellations must be made at least 6 hours before the scheduled class start time to avoid a penalty.

  • Late cancellations within 6 hours of class will result in a $15 fee and forfeiture of the class credit.

  • No-shows will be charged a $20 fee and result in forfeiture of the class credit.

  • Members on unlimited memberships are subject to two free late passes a month and then a $15 late cancel fee and a $20 no-show fee.

Cancellations can be made through the Mariana Tek app or website.

(5) Memberships & Packages

Auto-Renewing Memberships

Energi offers auto-renewing monthly memberships. By purchasing a membership, you authorize us to charge your payment method on file through Mariana Tek on a recurring monthly basis until cancelled.

All memberships require a minimum 3-month commitment. Early cancellation prior to the completion of the 3-month period is not permitted.

  • After the initial 3-month commitment period, memberships will continue to auto-renew on a monthly basis until cancelled.

  • To cancel your membership, you must provide written notice at least 5 days prior to your next billing date by contacting us at info@energistudios.co.

  • Cancellations cannot be processed in-studio. Requests must be submitted in writing.

  • Memberships may be frozen upon request, subject to studio policy at the time of the request.

Class Packages

  • Class packages are non-refundable and non-transferable.

  • Package credits expire 3 months from the date of purchase unless otherwise stated at the time of purchase.

  • Credits do not roll over between billing periods unless explicitly noted.

Pricing & Fees

Energi reserves the right to change pricing, membership rates, and fees at any time. You will be notified of any changes to your membership rate prior to the change taking effect.

(6) Payments

All payments are processed securely through Mariana Tek. By providing your payment information, you authorize Energi to charge your payment method for all purchases, fees, and applicable penalties.

  • All sales are final. We do not offer refunds on class packages, memberships, or single classes unless required by law.

  • If a payment is declined, we reserve the right to retry the charge and to suspend access to Services until payment is resolved.

  • You are responsible for ensuring sufficient funds are available for any recurring charges.

(7) Health, Safety & Liability Waiver

By using Energi’s Services, you acknowledge and agree to the following:

Physical Fitness Acknowledgment:

You represent that you are in good physical condition and have no medical condition, injury, or disability that would prevent or limit your safe participation in pilates or other fitness activities offered by Energi. If you have any health concerns, you are strongly encouraged to consult a licensed healthcare provider before participating.

Assumption of Risk:

You acknowledge that participation in pilates and related physical activities carries inherent risks, including but not limited to muscle strain, joint injury, or other physical harm. You voluntarily assume all such risks associated with your participation in Energi’s classes and activities.

Release of Liability:

To the fullest extent permitted by applicable law, you hereby release, waive, and hold harmless Energi, LLC, its owners, officers, employees, instructors, and independent contractors from any and all claims, damages, losses, or expenses, including personal injury, illness, or death, arising from your participation in any Energi class, session, or activity, whether caused by negligence or otherwise.

Medical Advice Disclaimer:

Nothing provided by Energi instructors constitutes medical advice. You are responsible for disclosing any relevant health conditions or injuries to your instructor prior to class.

Minimum Age:

Participants must be at least 18 years of age to attend classes. Minors between the ages of 16 and 18 may participate only with written consent from a parent or legal guardian.

(8) Studio Rules & Etiquette

To ensure a safe and welcoming environment for all members, you agree to abide by the following:

  • Arrive on time and check in before class begins

  • Clients mustbring a towel to all heated and non-heated Pilates and Yoga classes held at the studio. Towels are available for purchase at the studio if needed

  • Mats are provided by the studio

  • Notify your instructor of any injuries or physical limitations before class

  • Wear appropriate workout attire 

  • Silence your mobile phone during class

  • Treat staff, instructors, and fellow members with respect

  • Follow all instructor guidance during class at all times

Energi reserves the right to remove any participant from class or revoke access to Services for failure to follow studio rules or for conduct that is disruptive, unsafe, or disrespectful.

(9) Personal Belongings

Energi is not responsible for the loss, theft, or damage of any personal belongings brought into the studio. You assume all risk for any personal property while on studio premises.

(10) SMS / Text Messaging

By opting in to receive text messages from Energi, you agree to the following terms:

Program Description

By opting in, you agree to receive recurring automated text messages from Energi ("we," "us," "our") at the mobile number you provided. Messages may include appointment reminders, class updates, membership alerts, promotional offers, and customer support follow-ups. Consent to receive these messages is not a condition of any purchase.

Message Frequency

You may receive up to 3 messages per month. Message frequency may vary depending on your activity and interactions with us.

Message and Data Rates

Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Please contact your wireless carrier for details about your messaging plan.

How to Opt Out and Get Help

You can unsubscribe from SMS messages at any time by replying STOP to any message we send you. After you send STOP, you will receive a one-time confirmation message, and no further messages will be sent. If you want to rejoin, you can sign up again using the original opt-in method or reply START. For help or more information at any time, reply HELP to any of our messages. You can also contact our support team directly atinfo@energistudios.co.

Carriers are not liable for any delayed or undelivered messages.

(11) Intellectual Property

All content on the Energi website, including text, graphics, logos, images, and other materials, is the property of Energi, LLC and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, modify, or otherwise exploit any content from our website without our prior written consent. 

(12) Third-Party Services

Our website and Services may link to or integrate with third-party platforms, including Mariana Tek for scheduling and payment processing. These third-party services operate under their own terms and privacy policies. Energi is not responsible for the content, practices, or policies of any third-party service. We encourage you to review their terms before use.

(13) Indemnification

You agree to indemnify, defend, and hold harmless Energi, LLC, its owners, officers, employees, instructors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or related to: (a) your use of or inability to use our Services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your breach of any applicable law or regulation.

(14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ENERGI, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, INSTRUCTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF YOU ARE DISSATISFIED WITH ANY ASPECT OF OUR SERVICES OR THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF OUR SERVICES.

(15) Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Cuyahoga County, Ohio.

In the event of a dispute, the parties agree to first attempt to resolve the matter through good-faith negotiation. If a resolution cannot be reached, the parties agree to submit to binding arbitration in Cuyahoga County, Ohio, in accordance with the rules of the American Arbitration Association. The arbitrator’s decision shall be final and binding. The prevailing party shall be entitled to recover reasonable attorney’s fees and costs. 

(16) Changes to These Terms

Energi reserves the right to update or modify these Terms at any time. When we do, we will revise the date at the top of this page. Your continued use of our Services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

(17) Termination

Energi reserves the right to suspend or terminate your access to our Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, all provisions of these Terms that by their nature should survive will remain in effect, including ownership, liability limitations, indemnification, and dispute resolution.

(18) Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Energi with respect to your use of our Services and supersede all prior agreements and understandings. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
